Due Diligence as Legal Defense
Due diligence is, first and foremost, a legal defense in the case of prosecution for injuries or accidents
in the workplace. Practicing continuous due diligence however, requires commitment by every individual
in an organization. This course introduces due diligence as a legal defense for employers and employees.
Learners will also be introduced to the core occupational safety, health and environmental (OSH&E)
responsibilities of employers and employees.
An Internal Responsibility System (IRS) is critical to an organization’s OSH&E due diligence. This
course explains what an Internal Responsibility System is, why it is important and what are the key
challenges to implementing an IRS. This course also introduces the learner to the role collaborative
work teams play in successfully implementing an IRS and an effective OSH&E system.
Past approaches to the dilemma of workplace losses have
had mixed results. Contemporary organizations have increasingly transitioned to a Risk Management model
that is more in keeping with today’s focus on empowering people, is more cost effective and provides
excellent due diligence when practiced correctly. The course will introduce you to the Risk Management
process and how to prepare your organization to introduce the Risk Management process into your organization.
Due diligence requires that reasonable care be taken to prevent injuries or accidents in the workplace.
This course introduces the learner to the first stage of the Risk Management process: risk identification,
assessment and prioritization. This first stage enables an organization to define reasonable care
standards. Reasonable care standards are documented in the form of OSH&E policies that serve
as the guide to OSH&E action by the organization.
Planning a comprehensive and integrated OSH&E system is critical to due diligence. This course
will introduce you to OSH&E strategic planning fundamentals. Additionally, this course will
explain the four types of planning that when integrated, define the OSH&E strategic plan.
Management executes the OSH&E strategic plan by organizing, leading and controlling performance,
behaviour and attitude in the workplace. This course explains management theory and then takes the learner
through the critical organizing responsibilities that managers must assume to execute the OSH&E
system. Leading skills are important for managers because this is how managers build commitment
and enthusiasm for OSH&E.
Risk Management controlling is the process of monitoring the OSH&E system: collectively in terms
of achieving OSH&E strategic goals as well as controlling individual OSH&E actions. This
course explains preliminary, simultaneous and follow up Risk Management controls that every organization
should consider
